1. Introduction
These Terms of Service ("Terms") govern your access to and use of the Waver platform and related services (the "Services") provided by Waver ("we", "us", or "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Description of Services
Waver is a cloud SaaS platform that provides WhatsApp business automation, including team inbox, conversation flows, broadcast campaigns, contact management, knowledge AI, analytics, and third-party integrations. Waver is not affiliated with or endorsed by WhatsApp Inc. or Meta Platforms, Inc. Your use of WhatsApp is governed by their own terms and policies.
3. Accounts and Registration
You must create an account to use the Services. You agree to provide accurate and complete information, keep your credentials confidential, and accept responsibility for all activity under your account. You may request account deletion at any time by contacting hello@waver.co.
4. Fees, Payments, and Refunds
All fees are displayed in Indian Rupees (INR). Payments are processed via Razorpay. You authorize us and our payment processor to charge applicable amounts, taxes, and fees. Subscriptions renew automatically unless cancelled. We offer a 7-day refund window from the date of purchase. Refund requests after this period will not be processed. Contact hello@waver.co for refund requests.
5. Acceptable Use
You agree not to use the Services for any unlawful, fraudulent, abusive, or misleading purpose; send unsolicited or unauthorized marketing (spam); upload malware or interfere with the integrity or performance of the Services; or impersonate others. You are solely responsible for the content and messages you send and for compliance with applicable laws, including opt-in/opt-out obligations on WhatsApp.
6. Intellectual Property
The platform, software, logos, text, graphics, and other content are owned by Waver or used under license and are protected by intellectual property laws. No rights are transferred to you by virtue of using the Services. You may not copy, modify, distribute, or exploit any content without prior written consent.
7. Changes to the Services
We may modify these Terms at any time. Material changes will be posted on the Site and become effective upon posting. We may also modify, suspend, or discontinue any feature of the Services at our discretion for maintenance, updates, or security purposes.
8. Privacy
Personal data is handled according to our Privacy Policy. By using the Services, you consent to the collection and use of your information as described there.
9. Service Availability and Security
We use reasonable measures to keep the Services available and secure, including encryption in transit. However, no system is 100% secure and no guarantee of uninterrupted operation is made. We are not responsible for the availability of WhatsApp or any third-party service.
10. Suspension and Termination
We may suspend or terminate your account if you violate these Terms; fail to pay fees when due; provide false information; or act in a manner that harms Waver, other users, or third parties. Upon termination, your right to use the Services ceases immediately.
11. Limitation of Liability
To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind. We are not liable for indirect, incidental, special, or consequential damages. Our aggregate liability for all claims in any 3-month period will not exceed the amounts you paid to Waver in that period.
12. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Bangalore, Karnataka, India.
